Terms of Service

PLEASE READ THIS AGREEMENT CAREFULLY.

By checking the box marked “I agree to the Terms of Service” and completing your payment, you (“Potential Client”) enter into a binding agreement with Forstai Cyber Kinetics, LLC (“FCK Legal”).

Scope of Limited Engagement

Limited Service: You are engaging FCK Legal solely to perform a single, limited-scope initial consultation (the “Consultation”), lasting up to 30 minutes.

No Ongoing Representation: This agreement does not create an ongoing attorney-client relationship beyond the Consultation. FCK Legal is under no obligation to represent you in court, draft documents, negotiate on your behalf, or perform any additional work or give any legal advice unless a separate, written Engagement Letter is signed by both parties.

Fee Structure & ORPC Rule 1.5 Notice

Fixed Fee Amount: The total fee for the Consultation is $300 (the “Fee” ).

When the Fee is “Earned”:

Pursuant to Oregon Rules of Professional Conduct (ORPC) Rule 1.5(c)(3) , you are hereby advised that:

  1. The Fee is earned by FCK Legal upon receipt .

  2. The Fee will be deposited into a lawyer trust account (IOLTA) until such time as the scheduled consultation occurs, after which it will be considered “earned” regardless of the outcome of the Consultation and regardless of whether or not an attorney-client relationship is formed.

  3. You have the right to terminate this agreement at any time before the Consultation takes place.

  4. If you terminate the agreement before FCK Legal performs the service, you are entitled to a refund of any unearned portion of the Fee. The unearned portion of the fee will be calculated at our regularly hourly rate of $625/hour and will include all time spent in preparation for the Consultation and processing the refund, any travel time to and from a physical location where the Consultation was to have taken place, up to 15 minutes of time spent waiting for you to attend the Consultation (if cancellation was done within 1 hour of the scheduled meeting), and any costs associated processing refunds or credit chargebacks.

Scheduling & Cancellation Policy

Scheduling: Upon payment, your scheduled time will be booked on FCK Legal’s calendar.

Rescheduling: You may reschedule your Consultation without penalty up 30 minutes before the scheduled time. Consultation rescheduled within 30 minutes of the scheduled time will result in a decrease in Consultation time proportionate to the wait time.

No-Show / Late Cancellation: If you fail to attend your scheduled Consultation or cancel with less than 1 hour notice, FCK Legal reserves the right to retain the non-refundable portion of the Fee, as calculated above.

Conflict of Interest Check

If FCK Legal discovers a conflict of interest prior to or during the Consultation that prevents representation, FCK Legal will immediately decline or terminate the Consultation and promptly issue a full refund of the Fee.

Electronic Signatures & Acceptance

By clicking “I Agree” and completing your online transaction, you acknowledge that:

  1. You have read, understood, and agreed to these Terms.

  2. You explicitly consent to the fee arrangement outlined in above including how refunds are calculated.
